Enduring Power of Attorney

Prior to 1st October 2007 it was possible to appoint one or more people to help you to manage your financial affairs using an Enduring Power of Attorney.

It is no longer possible to create new Enduring Powers of Attorney since the law changed on 1st October, nor is it possible to make changes to Enduring Powers of Attorney which are already in existence.

If you have already made an Enduring Power of Attorney and now want to change it you will need to cancel the Enduring Power of Attorney and create a new Lasting Power of Attorney instead.

Many people created Enduring Powers of Attorney before the change in the law, and these will be valid for as long as they are required.

If you made an Enduring Power of Attorney and you subsequently lose the capacity to manage your financial affairs, your attorneys will need to make an application to the Court of Protection to register the Enduring Power of Attorney before they can take over managing your affairs for you.
